HOW TO REACH & UNDERSTAND
In these Conditions, "you" and "your" means any and all persons who booked the tour and are part of tour (including those who joined after amendment). "We", "us" and "our" means The Cabs. Here we have tried to provide all the terms & conditions in a easy to understand for a normal layman. Still in case of any confusion, you can write to us for clarification. We recommend to take latest print-out and keep with you for future reference.

AGREEMENT
We have number of websites providing tourism information for number of tourist destinations. By accessing, using, browsing or booking through our Web Site(s) or Directly or Indirectly through The Cabs or its representative(s), you agree that you have read, understood and agree to be bound by these terms and conditions and you agree to comply with all applicable laws, rules and regulations.

MAKING YOUR BOOKING
In order to confirm a booking, you or your group leader must complete all booking formalities with signature on personal visit to office. Signature is not mandatory if booking made by online medium. He/She should be expected to go through all our terms & conditions, clearly understand them and be agreed on them. He/She must be authorized to make the booking on behalf of his co-visitor, group members and guardians of all group members who are below 18 years of age. Advance payment is must to begin any kind of booking process. All bookings are subject to our Booking Conditions. Once we have received the booking request with advance payment, we will, subject to availability, confirm the tour or service by issuing a confirmation voucher to party leader or travel agent. You are expected to read the invoice carefully. Contact us immediately in case you find any information incorrect, incomplete, missing or confusing so that we can act upon at the earliest as it may not be possible to make changes later. If in between advance payment made and our proceeding for booking, any decided hotel room/s or safari ticket/s gets sold out, we will not proceed further till we get further instruction from guest-side. In such case, if guest believes that alternate options are not matching to their expectation, they may ask for money back for those unavailable services. On such requests, final decision will be taken by our team. If we donít receive all the due payment as per specified schedule, we will be entitled & authorized to treat you booking as cancelled by you and further treatment will be as per our cancellation policy.

SPECIAL REQUESTS
In case, you have any special request regarding your tour, you should inform us in you tour request, before tour confirmation. We will notify such request to our supplier so that it should be met in desired way. Furthermore, we have no liability to you if such requests are not met partially or fully.

PRICES OR QUOTATIONS
Prices quoted generally include accommodation charges with taxes, ground transfers with taxes (unless specified otherwise) and in some cases with specified meals (Breakfast / Lunch / Dinner). Prices do not however include any personal expenses or additional fees such as telephone calls, liquor, snacks, souvenir shopping, any therapy, cleaning, laundry etc.

PAYMENTS
For the services contracted, advance payment should be made to hold the booking on a confirmed basis and the balance amount (if any) needs to be paid either as per agreed schedule or till 36 hrs before arrival. We hold the right to decide upon the amount to be paid as an advance payment, based on the nature of services, vendor requirements and/or the time left for the commencement of the services. By any case, if balance payment is not made as per specified schedule, we retain the right to cancel or suspend all remaining services from immediate effect. Such service cancellations could be temporary or permanent as per conditions. We strictly do not have any provision for payment, from customer side, on last day of tour. In case of cancellation of remaining services from customer side, cancellation charge will be as per our cancellation policy.

PAYMENT MADE BUT NOT RECEIVED
If any payment made from guest side, by any mode, but not received into our account, will be counted as due payment. It is the responsibility of customer to make sure that payment is to be received into our account. If any payment made from guest side but not received into our account, due to any reason, it will be treated as NO payment. We will provide service only for that part, whose payment has been clearly received into our account.

MODE OF PAYMENT
Overseas advance payment can be made through Bank / Wire Transfer to our bank account. The transfer/processing charges levied by the bank need to be deposited in addition to the payment amount. We are in a process to install payment gateway system into our main website i.e. www.madhya-pradesh-tourism.com through which we have number of other options to accept payment as per convenience of guest. After commencement of tour, for any added service/s or for amended services, we accept payment only in cash Indian Rupee mode. Cheque or Demand Drafts are not accepted by any case. Upon arrival in India, the payment can be made through currency notes. In case of payments through a Credit Card, the bank transaction charges-as applicable-would be levied over and above the total amount.

AMENDMENTS BY CUSTOMER
All the amendments request received in written form only from booking person/party will be considered for further action. In case of person below 18 years age, request should be forwarded by his/her parent or legal guardian. Any requested change in tour plan, after final confirmation on tour program, which includes change in: hotel/resort, travel date, sightseeing schedule, transfers etc. will be considered as amendment. We charge our fee as 300 INR. per amendment request on per booking. This charge is in addition to the charge incurred in implementation & result of requested amendment. We donít guarantee the result of amendment request as during peak season of hotels, jungle safaris such request may not give positive output. Similarly certain service providers donít allow change in name, gender, age etc. due to which customer may have to bear the complete loss or re-booking.

CANCELLATION-REFUND CHART
In case of any cancellation of services but customer, after making of advance payment/s, his/her refund will be decided as per chart given below:

Note:
  • Here percentage calculation will be done from total tour cost and not from advance payment.
  • Above cancellation policy is applicable for normal and off season.
  • During "Peak-Season," which is defined by the density of tourist inflow in each region, and may vary from destination to destination and hotel to hotel, any particular hotel may implement a different cancellation policy than its normal cancellation policy. The travel agent is bound to follow the hotel specific cancellation policy; and in case of variation from the above stated policy, the excess in cancellation charges will be borne by the customer and not by us.
  • Transaction fee/charges will not be considered as part of refund. It will be in addition to cancellation charges and will be bear by customer.
  • In case you cancel the trip after commencement of tour, guest will not be entitled for any refund. Under very special condition, refund would be restricted to a limited amount that too would depend on the amount that we would be able to recover from the hoteliers we patronize. For unused hotel accommodation, chartered transportation and missed meals etc. we do not take any guarantee to refund.
  • Modifications/Cancellations sent directly to the hotel will not be honored. It should be done in written form through The Cabs.

NO SHOW/EARLY ARRIVAL /EARLY DEPARTURE/ LATE DEPARTURE
In case of any no-show, due to any reason, customer will not be entitled for any refund. In case of early arrival, customer will have to wait for turn or subject to availability, we will try to make arrangements but it should not be taken as guarantee. On early departure, customer will not be entitled for any refund. Customer have no right for late departure. Subject to availability, we will decide on late departure and this will be chargeable.

REFUND
In regard to refund of unused / underused/unutilized services (which are paid for and cancelled well in advance) the refund amount would be calculated on the basis of cancellation policy as described above and the money would be accordingly refunded to the person who has made the payment to us. Any refund against a payment received through a Credit Card, will be made on the same credit card only. Please note that the refund process may take 2 to 8 weeks due to banking procedures. No deductions (except the transaction charges) will be made for the refunds, which are made due to unavailability of services. If the services requested are unavailable during the requested period, we will offer best alternatives well before the commencement of the services and if the client does not find the alternatives acceptable, the advance will be refunded. However, once the alternative service is accepted by the client, cancellation of the same will be subject to the above stated cancellation policy.

CHANGE IN TARIFF OR TAXES
Please note that after the finalization of the tour/service cost, if there are any hikes in entrance fees of monuments/museums, taxes, fuel cost or guide charges, the same would be charged as extra as per actual from booking person/party/travel agent. Hotel Administration reserves all rights for revision in room tariffs until the actual check-in of the client. To confirm the reservation(s), the payment is made in advance based on currently applicable and published tariffs of the hotel. In an event of hike in room tariffs, by the hotel administration, the Travel Agent will not be liable for the additional supplement. The client is requested to note that under such rare but possible case, the client will be liable to pay the additional supplement as demanded due to the revision in tariffs. Travel Industry and Hotel Tariffs are governed by various Government Taxes and Levies. The tariffs quoted on "Tax Inclusive" basis generally include all applicable taxes and levies as on the date of quotation. In an event of change in the rate of Government Taxes and implementation of additional levies and/or taxes, the Travel Agent will not be liable for the additional taxes. The client is requested to note that under such rare but possible circumstances, the client will be liable to pay the additional taxes or levies as implemented.

ACT & BEHAVIOR
When you book your tour with us, you are expected to behave morally as usually as expected from a good traveler. During tour, jungle safari, village visits etc. you are expected to strictly follow the instructions given in sign boards or by your tour guide. We donít owe any responsibility for any fine, penalty, damage or loss caused due to action by you or by any group member. In case of any confusion or help you should consult to your tour guide or proper authority or authorized person. In case of any customer/group found, doing any unlawful or prohibited act, his/her services will be suspended/cancelled from immediate effect and under such conditions, such person/group will not be entitled for any refund.

TRAVEL DOCUMENTS
All the visitors are expected to visit with all the required legal & travel documents like Visa, Passport, Tickets, Passes, Permits, Hotel Vouchers etc with them during their tour. In case of any confusion, you can consult with us. We donít owe any responsibility for fine, loss, damage or legal action caused to absence, incomplete, illegal or unauthorized traveling documents. Similarly, we canít be held responsible for loss caused due to any false declaration or hiding any required fact.

INSURANCE
We strongly recommends, all our customers should take travel insurance but not limited to cancellation, delays, loss of deposit, medical expenses, personal accidents, loss of baggage and personal effects. The Cabs makes it a condition that the client is fully covered by life, property and medical insurance policy without which The Cabs cannot be held responsible for any claims.

FORCE MAJEURE
The Cabs shall not be responsible and/or liable for any damage caused to Client due to reasons beyond the control of The Cabs (force majeure / Vis majeure) no liability on the part of The Cabs arising in any way out of this contract, in respect of any tour, holiday, excursion facility shall exceed the total amount paid or agreed to be paid for the tour, holiday and shall in no case include any consequential loss or additional expenses whatsoever.

COMPLAINTS REGARDING BOOKING SERVICES
We will always welcome any of your suggestions, advice in order to improve the level of services and accommodation provided. We appreciate your feedback, comments and/or complaints regarding the services purchased through us. We consider our customers as our family members and believe in resolving all the matters with mutual consultation process. We have taken all reasonable care to make sure that all the services are provided to a reasonable standard and are provided as described in our different Web Sites. However, The Cabs is not responsible for any changes made by the supplier of which we have not been informed earlier. The Cabs will not be held responsible for any lapse in services provided by a third party vendor like a hotel, transporter, airline, railways etc. We take due reasonable care while patronizing a hotel; however, may not under any circumstances guarantee the standard of services provide at the hotel. We always try to ensure best services to our clients/customers without compromising on quality & service standard. E & O E - Errors and Omissions Excepted The Cabs. will not be responsible for any human error or typing error, which has gone unnoticed by the guest or the company's staff.

NEGATIVE PROPAGANDA
If any customer/organization/group will found doing our negative propaganda in social websites / social media/ public-platform, without any legal evidence or valid reason, he/she shall have to face defamation suit and other legal actions, including compensation, from our side.

AMENDMENTS IN TERMS & CONDITIONS
The Cabs, reserves the right to amend/modify the terms, conditions, and notices as suitable in the interest of the clients and the company; and to comply with the legal requirements governing the industry.

LEGAL JURISDICTION
For any dispute, the Civil Court of Jabalpur, Madhya Pradesh, India is to be acknowledged as the sole competent authority.

GENERAL DECLARATIONS
  • The Cabs acts only in the capacity of agent for the hotels, airlines, transporters, railways & contractors providing other services & all exchange orders, receipts, contracts & tickets issued by us are issued subject to terms & conditions under which these services are provided by them.
  • The hotel ratings given on our web sites are established by qualified travel experts, claimed by hotels/resorts in their website and do not reflect our opinion about the hotel or the service rendered by the hotel.
  • All itineraries are suggested itineraries, intended to give you a general idea of the possible trip schedule. Numerous un-avoidable factors such as weather, road conditions, traffic jam, the physical ability of the participants etc. may dictate itinerary changes either before the tour or while on the trail. We reserve the right to change, in good faith, on any schedule in the interest of the tour participantís safety, comfort & general well being.
  • We shall not be responsible for any delays & alterations in the program or expenses incurred - directly or indirectly - due to natural hazards, flight cancellations, accident, breakdown of machinery or equipment, breakdown of transport, traffic jam, weather, sickness, landslides, political closures or any untoward incidents.
  • We shall not be responsible for any loss, injury or damage to person, property, or otherwise in connection with any accommodation, transportation or other services, resulting - directly or indirectly - from any act of god, dangers, fire, accident, breakdown in machinery or equipment, breakdown of transport, wars, civil disturbances, strikes, riots, thefts, pilferage, epidemics, medical or custom department regulations, defaults, or any other causes beyond our control.
